Seeking Visitation Rights in Denton, TX?
We Put Your Child’s Best Interests First
Whether you are a mother or a father, you have certain visitation rights in the state of Texas. Visitation, or “possession and access” as it is known in Texas, refer to your physical custody of or time that you may visit your child. Visitation is closely tied with child custody and is similarly granted based on the “best interests of the child,” as determined by the court. Because visitation is typically based on an objective judgment, it is important that you have an experienced visitation attorney in Denton and the surrounding areas on your side who can advocate for you. At Navarrette Family Law, we have years of experience helping both mothers and fathers navigate the legal system. We are committed to preserving the best interests of your child as we work to protect your visitation rights.
Child Visitation Laws in Texas
, Unlike some other states, Texas follows what is known as a “standard possession order” instead of a standard visitation schedule. This allows equal possession and access of a child between both parents while simultaneously keeping the child’s best interests at the forefront.
How does the standard possession order work?
- First, third, and fifth weekends are granted to the non-primary parent
- Weekend time can begin after school on Friday, at 6 p.m. on Friday, or at another time and extends through 6 p.m. Sunday or at the start of school on Monday morning
- Holidays are split equally between parents, alternating each year
- Spring break vacation time is split equally between parents except when the non-primary parent lives more than 100 miles away; then, he or she always gets spring break with the child
Of course, every situation is different and what works for one family may not work for another. Judges are able to deviate from the standard possession order whenever appropriate and parents may work together to find a custom solution that fits their circumstances. In every case, the court always put the best interests of the child first.
