Texas Child Support Cap Increase 2025: What Parents Need to Know

Starting September 1, 2025, Texas will raise the cap on the income used to calculate child support from $9,200 to $11,700 per month. This means that when courts apply the child support guidelines, they will now base calculations on income up to $11,700, instead of the previous $9,200.

This adjustment is required by Texas Family Code §154.125, which mandates updates every six years to reflect inflation. The amount is determined using the Consumer Price Index (CPI) and rounded to the nearest $50.

Why the Change Matters

If the parent paying child support (the “obligor”) earns more than $9,200 per month, this update could increase their payments. For example:

  • One child: maximum support could increase from $1,840 (20% of $9,200) to $2,340 (20% of $11,700).
  • Two children: from $2,300 to $2,925.
  • Three children: from $2,760 to $3,510.

For families with more children, the percentage rises up to 40% of the capped income.

Who This Applies To

  • High-income earners: If your monthly net income is above $9,200, the new cap could increase your child support obligation.
  • Other parents: If your net income is under $11,700, your support will still be calculated based on your actual income.
  • Timing: The change applies to all new child support orders and modifications made on or after September 1, 2025.

What Parents Should Do

  • Review your current order. If you think this change may affect your payments, it may be time to consider a modification.
  • Gather financial records. Courts will need accurate income information to apply the updated guidelines.
  • Consult an attorney. A family law lawyer can explain how the change impacts your case and guide you through the process.

The 2025 child support adjustment is designed to keep payments aligned with today’s cost of living. For some families, this may mean increased financial support for children. For others, it may raise questions about fairness and affordability.
